On April 16, 2020, the Illinois Supreme Court issued a decision interpreting Section 24-6 of the Illinois School Code, relating to a school employee’s use of sick leave after the birth of a child in Dynak v. Board of Education of Wood Dale School District 7. In the decision, the Court ruled that Section 24-6 permits a school employee to use up to 30 days of accumulated sick leave during the six-week period immediately following childbirth. Once that six-week period has elapsed, the employee is not entitled to use paid sick days for birth unless there is another qualifying reason for the use of sick leave.
