Update: The Governor has signed SB 1569. The new law (known as Public Act 101-0643) is effective immediately. As a result, the SB 1569 requirements (explained in our legal update) are in effect. Late last month, the General Assembly passed SB 1569, which makes sweeping changes to the Illinois School Code in response to the ongoing COVID-19 pandemic and the Governor’s “Stay-At-Home” orders. The legislation, which is awaiting signature by the Governor, codifies several components of the Governor Executive Orders regarding schools and the ISBE’s guidance during the ongoing school closure period. SB 1569 also makes changes affecting special education requirements and employment.
Also, on May 29, 2020, the Governor enacted Executive Order 2020-39 to extend the school closures that began on March 17, 2020, through June 27, 2020.
However, only days later on June 4, 2020, the Governor enacted Executive Order 2020-40 permitting schools to reopen for limited in-person educational purposes during summer 2020, provided that schools follow Illinois Department of Public Health (IDPH) guidance and take required safety measures. In conjunction with this Executive Order, the IDPH and the Illinois State Board of Education (ISBE) issued joint guidance, Updated Summer School and Other Allowable Activities, Part 2- Transition Joint Guidance, which provides clarity on the allowable school activities and recommended safety protocols during Phase 3 of the Restore Illinois plan.
