U.S. DOE Issues New Guidance on Discipline of Students with Disabilities and Processing OCR Complaints

The U.S. Department of Education (U.S. DOE) has been focusing on students with disabilities this summer.  On Monday (July 18, 2022), the Office for Civil Rights (OCR) issued an updated manual for processing OCR complaints.  On Tuesday (July 19, 2022), OCR, the Office of Special Education Programs (OSEP), and Office of Special Education and Rehabilitative Services (OSERS) published several guidance documents addressing ongoing concerns about disparate discipline of students with disabilities and proper implementation of the IDEA’s and Section 504’s discipline provisions.
