On August 24, 2021, we sent a legal update advising that as part of its Return to School Roadmap, the U.S. Department of Education’s Office of Special Education and Rehabilitative Services (OSERS) published a “child find” Question and Answer document, indicating it was the first in a series of upcoming guidance documents addressing school districts’ and special education cooperatives’ obligations under the Individuals with Disabilities Education Act (IDEA) in light of the challenges created by the COVID-19 pandemic. On September 30, 2021, OSERS published the second guidance document in its expected series of IDEA guidance, a Question and Answer document (OSERS 9/30/21 Q & A) addressing the development and implementation of IEPs within the least restrictive environment.
